Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the WordWise AI mobile application and the website at wordwise-ai.com (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Scope of these Terms

These Terms of Service govern your use of:

• The WordWise AI mobile app (iOS), and
• The wordwise-ai.com website and related pages.

These Terms do not apply to third-party websites or services that may be linked from our properties.

3. Eligibility

You must be old enough to form a binding contract and at least the applicable age of digital consent in your jurisdiction. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Accounts and Security

You are responsible for the accuracy of your account information and for keeping your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use or security incident.

5. Subscriptions, Billing, and Cancellation (iOS)

Certain features require a paid subscription. Prices, taxes, and currencies are shown in the app and may change. Purchases, billing, renewals, and refunds are handled by the Apple App Store:

• Auto-renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
• Manage or cancel: Use your device settings (Settings → [Your Name] → Subscriptions) to manage or cancel.
• Refunds: Refunds, if any, are processed by Apple under its policies. We do not process refunds directly.

Free and premium features, limits, and fair-use quotas are described in the app and on our website.

6. User Content and License

You retain ownership of the content you add (e.g., vocabulary sets, translations, flashcards, notes, and generated texts where applicable). You grant us a limited, non-exclusive, worldwide license to host, process, and display your content solely to operate and improve the Service. You are responsible for the legality and accuracy of your content.

7. Acceptable Use and Fair Use

You agree not to misuse the Service. Prohibited conduct includes, without limitation: circumventing limits or quotas; automated or scripted access; scraping; reverse engineering; bulk account creation, reselling, or sharing accounts; introducing malware; and generating or distributing unlawful, harmful, or harassing content.

We may take proportionate actions to protect the Service and users, including warnings, rate-limiting, feature restrictions, temporary suspension, or termination. If you believe an action was taken in error, contact us.

8. Intellectual Property

The Service, including software, design, text, graphics, and trademarks, is owned by us or our licensors and is protected by law. Except for rights expressly granted in these Terms, no rights are transferred to you. You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse engineer it except where permitted by law.

9. Third-Party Services and Links

The Service may reference third-party services (including app store and payment processors) and may contain links to third-party websites. We are not responsible for third-party services or content, and your use of them is at your own risk and subject to their terms.

10. Privacy

Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect personal data, your privacy rights, and how to exercise them.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that learning outcomes are guaranteed.

12. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business interruption, arising from or related to your use of the Service. Our total liability for any claims arising out of or relating to the Service or these Terms will not exceed the amounts paid by you to us (if any) for the Service in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your content, your breach of these Terms, or your misuse of the Service.

14. Suspension and Termination

We may suspend or terminate your access to the Service (including paid features) if we reasonably believe you have violated these Terms, pose a risk to the Service or its users, or where required by law. You may stop using the Service at any time. Termination does not relieve you of any obligations incurred prior to termination. Sections that by their nature should survive termination will survive.

15. Account Deletion

You can delete your account at any time in Settings → Delete account. Deletion is permanent and removes your account and related data as described in the Privacy Policy. If you cannot access the app, email us from your account email to request deletion.

16. Changes to the Service

We may modify or discontinue features, impose new limits, or update the Service from time to time. If a change materially affects your paid subscription, we will provide notice in the app or by email where feasible.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email before they take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.

18. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to them or the Service will be governed by applicable law without regard to conflict-of-laws rules. If you are a consumer resident in the EEA/UK or another jurisdiction providing mandatory consumer protections, you may bring claims in your local courts. Nothing in these Terms deprives you of non-waivable consumer rights under applicable law.
